Pennsylvania Rep. Mike Kelly took his case to overturn the Pennsylvania election on the basis of the unconstitutionality (i.e., the Pennsylvania Constitution) of the unrestricted mail-in votes, to the U.S. Supreme Court today, after the Commonwealth Supreme Court dismissed the case as being filed “too late.” In fact, it is an open-and-shut case, since the Constitution specifies the specific and limited cases in which the legislature can arrange for
mail-in voting, but the legislature ignored that fact in voting last October to allow unrestricted mail-in voting.
“Kelly submitted an emergency petition Tuesday to the U.S. Supreme Court asking justices to nullify the results of the election in Pennsylvania, even though they were already certified by state officials including Gov. Tom Wolf on Nov. 24,” the Philly Voice reported today.
