According to data from the Transactional Records Access Clearinghouse, of the over 4,000 federal white-collar prosecutions in 2022, “under 1%, or only 31 of these defendants were business or corporate entities.”
Jake Johnson, writing for Common Dreams, points out that this is the lowest number of such prosecutions since records began to be tracked in 2004. Two decades ago, only 1% of cases resulted in a leniency agreement, but now over one-fourth of such cases end with the corporation promising to do better next time, while evading criminal charges.
