On July 25 U.S. District Judge Lindsay C. Jenkins for the Northern District of Illinois dismissed “in its entirety” the Trump administration’s lawsuit against Illinois, Cook County (Illinois) and the city of Chicago over “sanctuary city” policies. In the ruling Judge Jenkins stated that the Trump administration suit “lacks standing” and that “contrary to the United States’ arguments, the Sanctuary Policies here do not comparably regulate ICE operations or meddle with the contractual rights of private individuals working with ICE….The
United States’s complaint [Dkt. 1] is dismissed in its entirety without prejudice.” Judge Jenkins stated, “It would allow the federal government to commandeer States under the guise of intergovernmental immunity—the exact type of direct regulation of states barred by the Tenth Amendment.”
