Federal Judge Issues Order Directing DHS Not To Destroy Evidence

On Jan. 24, a federal judge ordered the U.S. Department of Homeland Security to preserve evidence related to the fatal shooting death of Alex Pretti by a Border Patrol agent in Minneapolis.

U.S. District Court Judge Eric Tostrud granted the temporary restraining order request from the Minnesota Bureau of Criminal Apprehension and Hennepin County Attorney’s Office. He wrote in his order, that federal officials and their employees “are ENJOINED from destroying or altering evidence related to the fatal shooting involving federal officers that took place in or around 26th Street and Nicollet Avenue in Minneapolis on January 24, 2026, including but not limited to evidence that [federal] Defendants and those working on their behalf removed from the scene and/or evidence that Defendants have taken into their exclusive custody.”
