Earlier this week, the German Federal Prosecutor in the Nord Stream terrorism case decided to characterize the incident as a “war crime,” which implies that the terror act could be investigated as an act committed by a state or state agency. This moves the trial up a level, against the alleged “private drivers team” and the indictment of Ukrainian Serhii K. for complicity in the Nord Stream pipeline bombing. Pending developments at the United Nations, the entire case could be transferred to the International Court of Justice. At the UN Security Council, Russia and China would support an ICJ mandate, France and the United Kingdom oppose it, as does the United States.
