Jeffrey Sachs Argues Why Tariff Policy Is Unconstitutional

Prof. Jeffrey Sachs, in an April 9 TV interview in India titled “Trump Watch,” described the Trump announcement of an emergency warranting his imposition of tariffs as illegal and unconstitutional. He described the situation in the U.S. as similar to the Cultural Revolution in China in 1966-1976, as a “political meltdown,” and a “one-man show,” something he said is uncommon in the U.S. The idea that one man can declare an “emergency” is “crazy, illegal and unconstitutional,” Sachs said. Article 1, Section 8 of the Constitution says that tariffs are the responsibility of the Congress, not the Executive.

He said there are three possible remedies:

1. The Courts could declare them unconstitutional
