U.S. Supreme Court Stops Use of Alien Enemies Act for Deportation

On May 16 the U.S. Supreme Court ordered the Trump administration to refrain from deporting people under the 1798 Alien Enemies Act (AEA). The Court issued an injunction and sent the case back to the Fifth Circuit Court.

This is the third time since early April that the U.S. Supreme Court has insisted on upholding due process in cases dealing with deportations. The Supreme Court ruled to maintain the current block against the AEA until it can fully consider the matter. However, three judges in the U.S. district courts in Colorado, New York, and Texas have all already ruled that the Trump administration’s invocation of AEA is unlawful and they have all rejected the administration’s claim that the country is being “invaded.”
